Policy and Procedure


I (the client) have carefully read this Terms and Agreement and fully understand its contents as well as the conditions below. I am aware that this is a release and waiver of liability, and I (the client) sign it knowingly, voluntarily, and of my own free will.


  • The client understands that a deposit (Booking Fee) will have to be paid to secure a booking. Respective deposits vary across packages and are stated on both the pricing page and the booking page!!
  • All Deposits (Booking Fee) are Non-Refundable and Non-Transferable
  • All prices are stated in USD!
  • Payment: The client acknowledges that the remainder of the balance is to be paid at the beginning of the shoot or at the time of booking via the accepted payment methods.
  • Accepted Payment Methods: Credit, Cash, Zelle, Apple Pay, CashApp, or Bank Transfer Is Accepted.
  • Reschedule Policy: The client recognizes their right to reschedule any session with at least 48hr Prior Notice with no additional fee being charged. The rescheduled session must take place within 30 days of the original appointment. After the 30 day deadline has passed, the client will need to rebook a new session with the required deposit (Booking Fee). The client accepts that the consequences of last-minute changes will result in the re-booking of a new session with the required deposit (Booking Fee).
  • A traveling fee is required for locations not accessible to me. The travel fee starts at $30
  • Shoots that require a traveling fee, and are out of state/country must be paid in full at the time of booking alongside the required deposit.
  • All traveling fees are Non-Refundable and Non Transferable.
  • Promotions/Discounts are N/A to the traveling fee.
  • Turnaround Time: The stated turnaround time for edited photos and final deliverables refers to business days only (Monday–Friday, excluding weekends and holidays). Delays due to unforeseen circumstances will be communicated promptly.
  • Deposit/Retainer Agreement: “For the purposes of this contract (Policy and Procedure), the terms ‘deposit’ and ‘retainer’ are, and may be used interchangeably, and shall both refer to a non-refundable and non-transferable payment made by the client to secure the services of the photographer. This payment is intended to reserve the specified date(s) and cover initial planning and preparation costs, and therefore, is not refundable or transferable under any circumstances, including but not limited to cancellation by the client.”
  • Image Proof Policy: A proof photo gallery is sent for viewing purposes to select your photos of choice. The client is entitled to keep the final edited photos for personal use, but the unedited photos (raws) are intended solely for proofing and reviewing purposes only, and may not be used or distributed without my written consent as the photographer. Any breach of this clause, wherein the raw photos are used or distributed without my written consent, will result in the forfeiture of the edited pictures associated with your shoot. This provision is in place to protect the integrity of my work and ensure that proper permissions are obtained for the use of all images. If you request additional edits, the payment transaction must be fulfilled via accepted payment methods. If not, you will only receive the number of edits that are included with your package. If you later decide to purchase an additional edit(s), the turnaround time will begin at the date a request is made for the specific image(s). The turnaround time starts once the selected photos for editing are submitted to me. Standard turnaround takes up to 10 days. Expedited orders are 1-3 day turnaround. The expedited order fee applies to the first set of requested photos. If later on you request additional edits and would want a 1-3 day turnaround time, you would have to pay a new "Expedite Order" fee; otherwise, turnaround will be the standard 7-10 days. This contract also serves as a model release. The client grants the photographer the right to use all images and footage without restriction for advertising, portfolios, and other lawful purposes. 
  • Image Alteration and Intellectual Property Policy: All images produced by Timoy B Photography are the exclusive intellectual property of the photographer. Clients are strictly prohibited from altering, editing, or modifying any images under any circumstances. This includes, but is not limited to, applying filters, cropping, or using third-party editing software. This policy ensures the consistency and integrity of the photographer’s work.

If additional edits or alterations are desired, clients may request them, but such edits will only be performed by the photographer and must align with the photographer’s editing style. These requests are at the sole discretion of the photographer.

Any breach of this policy may result in the client being blacklisted, potentially prohibiting future bookings with Timoy B Photography. Unauthorized edits and alterations can compromise the quality and style that other clients have come to trust and expect. A great deal of care and dedication goes into capturing and perfecting your photos, from planning and execution to post-processing, ensuring that each image is a cherished memory.

In the event of a policy breach, Timoy B Photography will make every effort to resolve the matter directly with the client. If a resolution cannot be reached, the photographer reserves the right to take any necessary measures to safeguard the integrity of their work.

  • Copyright Policy: All photographs/footage are and shall remain the sole intellectual property of the photographer in accordance with United States Copyright Laws. The client hereby waives any rights to intellectual property ownership, monetization, or reproduction of the images and footage created by the photographer, with the exception of the terms of any formal written releases provided to the client by the photographer. By agreeing to these terms & conditions, the photographer does grant the client the right to print images for personal or family use. The photographer grants the client the right to publish photographs on social media. If the client wishes to use images/footage for commercial, multimedia advertising, sale, etc., the photographer will provide the documentation and invoice for such matters.
  •  Photographer Usage Rights: The photographer retains the irrevocable and perpetual right to use any photographs/footage captured during the session for promotional, marketing, portfolio, website, social media, publication, competition, and commercial purposes, unless otherwise agreed upon in a separate signed written release prior to the session. The client waives any claims to royalties or compensation from such use.
  • Property Policy: Any damage done to the studio or property is subject to fees for compensation. The client understands they bear sole responsibility for maintaining the safety and security of all their items.
  • Insurance Policy: An optional insurance add-on may be available to cover damages to equipment, ensuring the protection of your session. In the case of reparable damages, the insurance add-on will serve as a claim/deductible to cover repair costs. However, if the equipment is rendered inoperable and requires replacement, a flat rate claim/deductible, less the insurance add-on, will be invoiced to you. If the market value of the inoperable equipment is lower than the flat rate claim/deductible, the market value will be invoiced instead. This insurance add-on must be added at the time of booking and is non-refundable and non-transferable. You, the client, are also responsible for any additional parties and would be liable for any events on their behalf. In the event You, the client, declines the insurance protection, you will bear sole responsibility for the full cost to replace the item on both you and your parties behalf. This policy ensures the safety and security of all parties and sessions.
  • Late Arrival Policy: Clients are expected to arrive at the scheduled shoot time. Any delays in client arrival, unless discussed with the photographer, may result in a shortened session. If the client requests to extend the session to make up for the time allotted, the photographer reserves the right to charge additional fees for extending the session beyond the scheduled end time based on the additional time add-on associated with the clients package.
  • Force Majeure: In the event that the scheduled shoot cannot proceed due to circumstances beyond the control of either party (e.g., natural disasters, acts of God, etc.), both parties agree to work together to reschedule the shoot at a mutually agreeable time. The deposit (Booking Fee) paid by the client is non-refundable in such circumstances, but the client may reschedule the shoot without penalty.
  • Timoy B Photography Signature Membership

To ensure clarity and a seamless experience for all members, the following policies and procedures apply to the Timoy B Photography Signature Membership.


1. Membership Terms & Renewal

• Membership is valid for one year from the date of purchase.

• Membership must be paid in full at the time of enrollment.

• Memberships are non-refundable and non-transferable.

• Members may renew annually, and renewal pricing will be based on current rates at the time of renewal. Current rate is $750.


2. Booking & Session Policies

• Members must schedule sessions in advance via the Timoy B Photography booking system.

• Sessions are subject to availability, and members are encouraged to book early to secure preferred dates.

• Rescheduling & Cancellations:

• Members may reschedule any session with at least 48 hours’ notice at no additional charge. The rescheduled session must take place within 30 days of the original appointment. If the session is not rescheduled within this timeframe, the member must book a new session with the required deposit (Booking Fee).


3. Complimentary & Discounted Services

One Free 1-Hour Session (Outdoor OR Studio)


• Members receive one complimentary session per membership year.

• Standard inclusions apply based on Tier package offerings.

• Add - On’s are available based on current pricing.


25% Off Additional Sessions


• The discount applies to all lifestyle, studio, and graduation photography packages.

• Does not apply to event photography, branding photography, commercial projects, or special promotions unless otherwise stated.


Complimentary One-Tier Upgrade (2x Per Membership Year)


• Members can upgrade from Tier 1 to Tier 2 or from Tier 2 to Tier 3 for lifestyle & studio sessions only.

• Upgrade must be requested at the time of booking and cannot be applied retroactively.

• Not valid for event photography or commercial shoots.


Exclusive Content Day Event (Members-Only, Once Per Year)


• Date(s) will be announced in advance, and members must RSVP to secure a slot.

• This session is complimentary, but no reschedules will be offered if a member cannot attend.


$100 Annual Add-On Credit


• Can be used on any add-ons currently available within your package. 

• Can be split across multiple sessions or used all at once.

• Non-transferable & does not roll over into the next membership year.


4. VIP Booking Access & Expedited Editing

• Members receive priority scheduling with no blackout dates.

• Expedited Editing: Members’ sessions are edited within 1-3 business days (compared to standard turnaround 7-10 business days).


5. Referral Program ($75 Credit Per Referral, Up to $750 Per Year)

• Members receive a $75 credit for each person who purchases a membership using their referral. Credits can be used toward future sessions or add-ons. A maximum of 10 referral credits can be earned per membership year (up to $750 total value). Unused referral credits do not roll over.


6. Membership Termination

• Timoy B Photography reserves the right to terminate a membership in cases of policy violations, including but not limited to:

• Misuse of membership perks

• Abusive or inappropriate behavior

• Repeated last-minute cancellations or no-shows

In the event of a policy breach, Timoy B Photography will attempt to resolve the matter directly with the client. If a resolution cannot be reached, membership may be terminated without refund.


7. All Sales Are Final!

By purchasing the Timoy B Photography Signature Membership, you acknowledge that you have read, understood, and agreed to these membership policies and procedures in addition to standard policy and procedure.
